ORDER

The present Criminal Original Petition has been filed by A1 to A4 in Crime No.101 of 2025 on the file of the first respondent police for the alleged offence under Sections 294(b), 49, 115(2), 351(3), 85 and 109 of BNS, 2023 r/w. Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002.

2. Pending investigation, the parties have entered into compromise and the defacto complainant/wife had agreed for quashing of the FIR and they have also filed an application before the Family Court, Madurai for granting divorce in mutual consent.

3. Today, the defacto complainant is present in-person and she acknowledges the fact that she had agreed for quashing of the F.I.R. 2/5

The learned counsel appearing on either side submits that the parties have filed an application for mutual consent under Section 13 (B) of the Hindu Marriage Act, 1955, before the Family Court, Madurai, and it has been taken on file in H.M.O.P.No.817 of 2026 and it has also been adjourned to 07.12.2026. They seek indulgence of the Court for a direction for early disposal of the said case without waiting for the cooling period.

5. In view of the above said facts, this Court is inclined to pass the following order:

(a) The FIR in Crime No.101 of 2025 on the file of the first respondent stands quashed. The joint compromise memo shall form part and parcel of the order.

(b) The Family Court, Madurai is directed to dispose of H.M.O.P.No.817 of 2026 on or before 31.08.2026 without waiting for the six months cooling period.
