ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the respondents 1 to 3 to consider and dispose of the petitioner's representation, dated 12.05.2025.

2. The contention of the petitioner is that the fourth respondent is erecting a windmill without obtaining any permission from the competent authorities. The said construction is affecting the petitioner's dwelling house and apart from the petitioner's house, there are 25 dwelling houses in the said place. None of the persons have granted any permission for the erecting windmills. Therefore, the petitioner has approached this Court by filing the present writ petition.

3. The learned Special Government Pleader, on written instructions, submitted that based on the petitioner's representation, the official respondents visited the spot and found that the allegations made in the complaint are true. 2/5

4. Therefore, this Court is directing fourth respondent to stop putting up further construction. In case, if any windmill or any other high-tension towers ought to be erected, the competent authority for granting such permission is the District Collector. Therefore, the District Collector is directed to consider the petitioner's representation, after issuing notice to the petitioner, the fourth respondent and the 25 other dwellers who were residing near the alleged construction and thereafter, pass appropriate orders in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of this order.

5. With the above said directions, this Writ Petition is disposed of. There shall be no order as to costs.
