To admit the appeal, call for the records and set aside the conviction and sentence imposed by the Learned II Additional District Judge for CBI Cases, Madurai vide his judgment dated C.C.No.2/2011 dated 12.03.2020, acquit the appellant. PRAYER IN CRL MP(MD)No.2964 of 2020 in CRL A(MD).154/2020: To suspend the sentence imposed by the learned II Additional District Judge for CBI Cases, Madurai vide his judgment dated in C.C.No.2/2011, dated 12.03.2020 and to enlarge the petitioner/Accused No.1 bail pending disposal of the Criminal Appeal.
Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.N.KARTHICK KANNA, Advocate for the petitioner and of M/S.VICTORIA GOWRI, Assistant Solicitor General on behalf of the Respondent, the court made the following order:- By order dated 15.11.2021 in Crl.M.P.(MD)No.9562 of 2021, the condition already granted has been modified to the effect that the petitioner must appear before the respondent police once in six months on the first working day, until further orders. https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL MP(MD) No.9562 of 2021 2.Today, when the appeal is taken up for hearing, the learned counsel for the appellant would submit that he is not able to travel to Chennai from Trichy to comply with the said condition. 3.Therefore, the condition is modified to the effect that the the petitioner is directed to appear before the trial Court once in six months, on the first working day, until further orders. 4.List the appeal on 03.01.2022 along with Crl.A.(MD)Nos.163 and 164 of 2021.
