As the erstwhile learned counsel appearing for the appellant reported 'no instructions', pursuant to which, this Court directed the Registry to issue notice to the appellant and the same was returned as 'no such addressee'. The bailiff has also made an endorsement that there was no such person living in the said address. Therefore, the name of the appellant was directed to be printed in the cause-list. The learned counsel appearing for the respondent is also unable to say the correct address of the appellant. Therefore, we take it that the appellant is not interested in prosecuting the appeal. Hence, the Civil Miscellaneous Appeal is dismissed for non-prosecution. No costs.
