ORDER : The Court made the following order :- The petitioner/Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 379 IPC r/w 21(1) of Mines and Minerals Act, in Crime No.184 of 2022, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 10.08.2022, the accused was found in possession of 2 cement bags of river sand, without any valid permit. Hence, the complaint.

3. On the side of the petitioner, it is stated that the petitioner is innocent and has not committed any such offence, as alleged by the prosecution. Hence, prays to release him on anticipatory bail.

4. On the side of prosecution, it is stated that petitioner is having eight previous cases, out of which, one case is similar in nature and prayed to dismiss the petition.

CRL OP(MD). No.15912 of 2022 5.Considering the nature of the case and fact that the petitioner is having eight previous cases, this Court is not inclined to grant anticipatory bail to him.

6. Accordingly, this Criminal Original Petition stands dismissed.
