PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus to direct the first respondent to issue passport by processing the application No.TR1084909592525, dated 15.11.2022 within a stipulated time period in accordance with law on the basis of the explanationcum-representations, dated 11.06.2025 and 12.07.2025. ORDER

This Writ Petition is disposed of at the time of admission with the consent of the learned counsel for the petitioner, learned Central Government Standing Counsel for the first respondent and learned Government Advocate (Crl.Side) for the respondents 2 to 4.

2. It appears that the petitioner was an accused in following cases as detailed below:

4. The learned counsel for the petitioner states that as far as the second and third FIRs are concerned, the cases have been disposed of. As far as the first case is concerned, the case is still under investigation.

5. Considering the same, there can be no impediment for issuing passport to the petitioner pursuant to the application filed by the petitioner in application No.TR1084909592525, dated 15.11.2022.

6. However, since there is considerable lapse of time from the filing of an 3/6

application by the petitioner, the same may be closed. Hence, the petitioner may be permitted to file fresh application, if the application filed on 15.11.2022 has been closed, in which case the passport application of the petitioner shall be scrutinized and passport shall be issued to the petitioner as expeditiously as possible.

7. It is made clear that in case, charge sheet is filed against the petitioner and the same is taken on file by the concerned Court, the petitioner shall surrender the passport before the concerned Court and shall move appropriate application, in case, the petitioner desires to travel abroad.
