ORDER
This Writ Petition is filed seeking to issue a Writ of Mandamus directing the respondents to settle petitioner's leave salary from the year 2008 to 2018 with interest at the rate of 18% per annum.
2. When the matter is taken up for consideration, it is submitted by the learned counsel appearing for the respondents that the leave salary payable to the petitioner was already paid on 21.02.2023. However, no interest is paid. He also further submitted that the respondents are ready and willing to pay the interest on the belated payment of leave salary amount at 4% per annum and the same would be paid within a period of three months.
3. In the light of the above, there is no necessity to go into the merits of the case, However, the offer made by the learned counsel for the respondents to pay interest at the rate of 4% per annum is inadequate as the petitioner has already retired from service in the year 2018 and the amounts
due and payable as on the date of retirement are paid belatedly after a lapse of five years, this Court is of the considered view that it would be appropriate to direct the respondents to pay the interest on the belated payment of leave salary amount at the rate of 6% per annum.
Accordingly, the Writ Petition is disposed of directing the respondents to pay interest at the rate of 6% per annum on the amounts belatedly paid to the petitioner within a period of three months from the date of receipt of a copy of this order. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed. 19.02.2024 NCC : Yes/No Index : Yes/No Internet : Yes kpr
