For Respondent : Mr.B.Thanga Aravindh Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL UNDER SECTION 482 OF BNSS PRAYER :- For Anticipatory Bail in Crime No.13/2024 on the file of the respondent police ORDER : The Court made the following order :- The petitioner, who is apprehending arrest at the hands of the respondent police for the offence under Sections 408, 465, 477(A) of IPC r/w 66(c) of IT Act, in connection with Crime No.13 of 2024, on the file of the Cyber Crime Police Station, Virudhunagar, has approached this Court, seeking anticipatory bail. 1/3

2.The allegation as against this petitioner is that the petitioner, as a Postal Assistant, working in the Head Post office, Virudhunagar was on deputation at Aruppukottai Head Post Office from 20.04.2023 to 02.05.2023 and during the relevant period, he has used an ID of a co-employee and swindled a sum of Rs.5 Crores from the accounts of the depositors in the Post office. Hence, the case. 3.The earlier application filed by this petitioner was dismissed by this Court in Crl.OP(MD) No.8526 of 2024, considering the nature of allegations as against this petitioner.

4.This is the second application filed by this petitioner stating that without prejudice to his claim, the petitioner is prepared to deposit the entire amount before the postal Department. Considering this request made on behalf of this petitioner, this application is entertained by this Court and an opportunity was also provided to this petitioner. The petitioner has also deposited a sum of Rs.20 Lakhs to the credit of Post Master on 02.09.2024, 03.09.2024 and 04.09.2024 and he has produced receipts for the same. Therefore, further time was also granted to this petitioner to deposit the remaining amount, by order, dated 06.09.2024. 5.Though this Court has provided sufficient time to this petitioner, he has failed to pay the balance amount as undertook by him. 6.The learned Government Advocate (Crl.side) has raised strong 2/3

objections that a sum of Rs.42 Lakhs has to be recovered from this petitioner. 7.Considering the allegations as against this petitioner and the conduct of this petitioner, this Court is not inclined to grant anticipatory bail to this petitioner.
