PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying to direct the Respondents not to harass the Petitioner. 1/6

O R D E R

This Criminal Original Petition has been filed to direct the Respondents not to harass the Petitioner.

2.The learned Counsel for the Petitioner would submit that the Petitioner's son was involved in a murder case in 2020. There are some other cases also pending against the Petitioner's son. The Petitioner is not residing with his son. While so, the Respondents 3 to 5 are constantly harassing the Petitioner seeking the details of his son. Therefore, the Petitioner had come before this Court by filing this Petition under Section 482 of Cr.P.C., 3.The learned Government Advocate (Crl.side) would submit that there are five cases pending against the Petitioner's son and he is the wanted person for the criminal cases in the limits of Respondents 3 to 5. Non Bailable Warrant is also pending against him in a murder case. Also, the 2/6

Respondents 3 to 5 have moved the District Collector to detain the Petitioner's son under Gundas Act.

4.It is the further submission of the learned Government Advocate (Crl.side) that the Petitioner's son is residing with the Petitioner in the same address. That is why, the Respondents 3 to 5 are calling upon the Petitioner seeking the details of his son. It is the further submission of the learned Government Advocate (Crl.side) that the Petitioner is not cooperating with the enquiry held by the Respondents 3 to 5. Therefore, the learned Government Advocate (Crl.side) seeks to dismiss this Petition. 5.When the Petitioner claims that he is not residing with his son, the Petitioner shall furnish the details of his son. Naturally, when there are cases pending against the Petitioner's son, the police Officer, who is investigating the cases against his son, are due to bound call on the Petitioner to know the details of his son.

As a citizen of this country, the Petitioner is due to bound to help the police Officials, who seek details regarding criminal cases. Even though there are no cases against pending against the Petitioner, it is the submission of the learned Government Advocate (Crl.

When they are residing in the very same address, the police Officials are due to bound to call on the residence of the Petitioner. 6.In the light of the submission made by the learned Government Advocate (Crl.side), this Petition is dismissed. The Petitioner is directed to cooperate with the pending investigation.
