ORDER
This Criminal Original Petition has been filed, invoking Section 528 of BNSS., seeking orders, to direct the first respondent to direct the third respondent to give police protection for his life and limb of the petitioner and his family members.
2. When the matter is taken up for hearing today, the learned Government Advocate (Criminal Side) appearing for the State would submit that the petitioner himself has given a letter, dated 07.03.2024 to withdraw the compliant and on that basis, the complaint was ordered to be closed.
3. But, it is seen from the alleged letter dated 07.03.2024 that the complaint given by the petitioner was withdrawn only as against Sarathkumar, S/o.Balasubramaniam, not in respect to the fourth respondent herein and that the said compliant itself was ordered to be closed on 14.06.2024 and there is absolutely nothing about the fourth respondent. 2/5
4. It is seen that the petitioner has again sent a compliant on 18.07.2024 to the Commissioner of Police as well as the third respondent and the same are pending.
5. Considering the facts and circumstances of the case and also the submission made by the learned Government Advocate (Criminal Side), the third respondent is directed to issue notice to the petitioner as well as the private respondent and consider the petitioner's compliant given on 18.07.2024 and pass orders within a period of two weeks from the date of receipt of a copy of this order.
6.With the above direction, this Criminal Original Petition stands disposed of.
