For Respondent : Mr.S.Manikandan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime no.288 of 2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/Accused No.3, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 381, 411 & 414 of 1/4
IPC in Crime No.288 of 2023, on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the defacto complainant is running a vessel shop at Kumbakonam. The accused persons are their workers. While so, reconstruction work was going on in that shop. Taking advantage of the same, the petitioner along with co-accused stolen the vessels from the shop. Hence, the complaint.
3.The learned Additional Public Prosecutor would submit that the worth of the articles stolen from the above said shop is Rs.4.50 lakhs. Some of Rs.2,00,000/- was recovered from one Murugan, who is the receiver of stolen articles from this petitioner, who was also released on bail by this Court, by the order dated 26.06.2023. Similarly, one Karthik was also moved anticipatory bail. He was also granted bail with condition of payment of Rs.50,000/-. Accused Nos.1 and 2 were also moved similar application for bail. They were also granted bail. This petitioner is shown as A3.
4.Considering the release of co-accused on condition of payment, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner shall deposit Rs.50,000/- (Rupees Fifty Thousand only) to the credit of the crime No.288 of 2023, before the trial Court. 2/4
5. On such deposit being made, this Criminal Original Petition is allowed and petitioner is ordered to be released on bail in the event of arrest or on his appearance, before the learned Judicial Magistrate No.I, Kumbakonam, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and the petitioner shall appear before the respondent police daily at 10.30 a.m. until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
6. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed. sd/- 01/08/2023 / TRUE COPY / /08/2023 Sub-Assistant Registrar (C.S.)
