PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondents No.1 to 4, to mutate all the revenue records in respect of S.F.No.390/9B1, to an extent of 0.24.5 hectares at Akkiyampatti Village, Palayapalayam Post, Marungapuri Taluk, Trichy District, in favour of the petitioner, in continuance with the proceedings in Moo.Mu.A5/3086/2020, dated 09.11.2020, initiated by the 3rd respondent, based on the petitioner's representation dated 08.07.2025. 1/4

ORDER
The petitioner herein seeks a direction to the respondents 1 to 4 to mutate the revenue records in respect of the subject property situated in S.F.No. 390/9B1, to an extent of 0.24.5 hectares in Akkiyampatti Village, Palayapalayam Post, Marungapuri Taluk, Trichy District, by considering his representation, dated 08.07.2025.
2.According to the petitioner, the subject property is an ancestral property and patta for the said property was wrongly issued in the name of the three persons, namely, Alagan, Chinnalagu and Andikannu. In order to assert the right of the petitioner family over the subject property, the petitioner's father Vallan @ Perumal Vallan has filed a civil suit in O.S.No.79 of 2010, on the file of the District Munsif Court, Manapparai, seeking permanent injunction. The said suit was decreed in favour of the petitioner father on 06.11.2013. Thereafter, the petitioner father approached the respondents seeking issuance of patta based on the civil Court findings. However, due to the pendency of the 2/4
appeal filed by the rival parties, the respondents informed the petitioner that the request for mutation of the revenue records would be considered only after disposal of the appeal. Now, the appeal filed by the rival parties in A.S.No.7 of 2019, on the file of Sub Court, Manapparai, was disposed of in favour of the petitioner's father on 01.04.2024. Based on the said judgment and decree, the petitioner has submitted an application on 08.07.2025, seeking mutation of the revenue records in the name of his father. The same has not been considered. Hence, the petitioner has come before this Court. 3.The learned Government Advocate, who takes notice for the respondents 1 to 4, submits that the representation of the petitioner will be considered in accordance with law.
4.In view of the same, without expressing any opinion on the merits of the matter, the third respondent is directed to consider the application of the petitioner, dated 08.07.2025, and pass final orders on its own merits within a period of twelve weeks from the date of receipt of copy of this order, after issuing notice to the petitioner, 5th respondent and other rival parties. 3/4
