on 20.12.2024 for the offence punishable under Sections 296(b), 103, 351(3) of BNS, in Crime No.502 of 2024 on the file of the respondent police, seeks bail,

The case of the prosecution is that on 19.12.2024, the petitioner quarreled with his wife and cut her neck with knife and stabbed on her face repeatedly with knife due to which she died on the spot in pool of blood. Subsequently, he cut the dead body of his wife into several pieces and packed the same in two carry bags and he dragged the bags. At that time, two dogs barked at him and so, the defacto complainant, who is the neighbour and others suspected and opened the bags and found dead body. Hence, the complaint.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready and willing to abide by any stringent conditions that may be imposed by this Court. He further submitted that the petitioner is in judicial custody from 20.12.2024. Hence, he seeks bail to the petitioner.
4. The learned Government Advocate (Criminal Side) submitted that the 2/4
petitioner is the husband of the deceased and he cut the neck of the deceased and cut the body in several pieces. He further submitted that there are 7 previous cases pending against the petitioner. If he released on bail, he may be abscond. Hence, he opposed for grant of bail to the petitioner.

Considering the facts and circumstances of the case and also the fact that the petitioner has committed serious offence and there are 7 previous cases pending against the petitioner, if enlarging the petitioner on bail at this point of time, when the offence is serious in nature, there is likelihood of the petitioner indulging in activities which would be prejudicial for fair trial and considering the bad antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner.
