Respondents Prayer: Writ petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent No.3 to assess the property tax relating to the newly constructed building with the petitioner's own cost in door No.10/8, Sudam Samiyar Lane, Madurai - 1 on the basis of the application for assessment of appropriate property tax submitted by the petitioner dated 18.06.2013 within the time stipulated by this Court. Heard the learned counsel on either side.
2. The petitioner wants the petition mentioned property to be assessed in his name.
3. The learned Standing counsel appearing for the respondent Corporation points out that according to them, the property belongs to the fourth respondent mutt and that the assessment has already been made in favour of the fourth respondent mutt. As rightly pointed out by the learned Standing counsel, the petitioner is asking for the following two reliefs:
a) The property should be assessed.
b) The property should be assessed in his name.
4. In the case on hand, the property has already been assessed and the assessment has been made in favour of the fourth respondent mutt. It is for the petitioner to contest the same in the manner known to law. Therefore, nothing survives for further adjudication in this writ petition. This writ petition stands closed. No costs.
