ORDER

Heard the learned counsel on either side.

2. The petitioner seeks issuance of passport.

3. When the matter was taken up for hearing, the learned Government Advocate (Criminal Side) appearing for the second respondent submitted that the petitioner was implicated in Crime No.102 of 2019 on the file of Athanakottai Police Station and absconding charge sheet has been filed before Judicial Magistrate, Kantharvakottai. The petitioner has to necessarily appear before the learned Judicial Magistrate, Kantharvakottai and get the warrant recalled. The petitioner is permitted to move the learned Judicial Magistrate, Kantharvakottai seeking the relief now sought for in the writ petition. As and when such Miscellaneous Petition is filed, the learned Judicial Magistrate, Kantharvakottai is directed to pass order on merits and in accordance with law within a period of three weeks thereafter. I make it clear that I have not gone into the merits of the matter.

4. With this liberty to the writ petitioner and direction to the learned Judicial Magistrate, Kantharvakottai this writ petition is disposed of.
