Mr.C.Jeganathan, learned counsel for the Government of Tamil Nadu, takes notice for the respondents.

2. With the consent of both sides, this writ petition is disposed of at the admission stage.

3. Heard the learned counsel for the petitioner and the learned counsel for the Government of Tamil Nadu appearing for the respondents.

This writ petition has been filed seeking a writ of mandamus directing the first respondent to include the name of the petitioner in the panel of the year 2025-2026 for promotion to the post of Deputy Collector on par with his immediate junior M.P.Murugaian and to promote the petitioner to the post of Deputy Collector from the date of promotion given to his batchmates on 09.01.2026, since the charges pending against the petitioner were dropped on 18.06.2026 by the third respondent and hence, to consider the petitioner for promotion forthwith, because he is due for retirement and attaining the age of superannuation on 30.06.2026, based on the representation dated 19.06.2026 submitted by him.

The case of the petitioner is that he is working as Tahsildar and he is eligible for promotion to the post of Deputy Collector and also falling within the zone of consideration for the panel year 2025-2026. However, his case was not considered by the respondents as the disciplinary proceedings, that were initiated against him, were pending as on the date of preparation of panel for the year 2025-2026. However, the disciplinary proceedings, that were pending against the petitioner as on the date of preparation of the panel for the year 2025-2026, have come to an end through proceedings bearing

Na.Ka.No.Pa.A5/e-313716/2022, dated 18.06.2026, issued by the third respondent, whereby the charges, that were framed against the petitioner, were dropped. Thus, the petitioner claims that, in the light of dropping of the charges framed against him, which is the only reason for not considering his case for promotion to the post of Deputy Collector for the panel year 2025-2026, he is entitled for promotion to the said post on par with his immediate junior one M.P.Murugaian for the panel year 2025-2026. As the petitioner is due for retirement and attaining the age of superannuation tomorrow i.e. 30.06.2026, he has approached this Court by filing the present writ petition contending that in spite of he submitting a representation on 19.06.2026, the respondents are not considering his case for promotion to the post of Deputy Collector for the panel year 2025-2026 on par with his immediate junior, though he is entitled for promotion to the said post.

Taking into consideration the fact that the petitioner is due for retirement tomorrow i.e., 30.06.2026, this Court is of the considered view that it would be appropriate to direct the respondents to consider the case of the petitioner for promotion / notional promotion on par with his immediate junior, if he is otherwise entitled to.

7. At this juncture, Mr.C.Jeganathan, learned counsel for the Government of Tamil Nadu, also fairly submitted that the respondents would consider the case of the petitioner for promotion in accordance with law.

In the light of the above, this writ petition is disposed of directing the respondents to consider the representation dated 19.06.2026 submitted by the petitioner by duly taking into consideration the proceedings bearing Na.Ka.No.Pa.A5/e-313716/2022, dated 18.06.2026, issued by the third respondent, and pass appropriate orders on the claim of the petitioner for promotion to the post of Deputy Collector for the panel year 2025-2026, as expeditiously as possible, at any rate, within a period of twelve weeks from the date of receipt of a copy of this order. No costs. 29.06.2026 NCC :
