Respondent/Complainant Prayer :- Criminal Original Petition has been filed under Section 482 of Crimianl Procedure code,to call for the records pertaining to the complaint in C.C.No.211 of 2018 on the file of the learned Judicial Magistrate, Fast Track Court (Magistrate Level), Thoothukudi and quash the same.

ORDER:- This Original Petition having been posted under the being mentioned on 4/07/2022 and upon perusing the petition and the affidavit filed in support thereof and the order dated 18/04/2022 upon hearing the arguments of Mr.AR.L.Sundaresan Senior Advocate for Mr.S.Sekar and of for the Petitioner and of Mr.K.Veilmuthu Advocate for the respondent(s), this Court made the following order: At the instance of the learned counsel for the petitioners, the matter is listed today under the caption "for being mentioned". 2.The learned counsel for the petitioners submits that the petitioners are residing in Chennai and the case is pending at Thoothukudi. So, they are not in a position to travel long distance to attend every hearing. So, the learned counsel submits that the petitioners' personal appearance may be dispensed with before the trial Court.

CRL OP(MD). No.21554 of 2018 3.In view of the submission made by the learned counsel for the petitioners, the personal appearance of the petitioners is dispensed with before the trial Court with the following conditions:- the petitioners shall appear before the trial Court, within 15 days from the date of receipt of a copy of this order and they shall file an undertaking affidavit that they will appear before the concerned Court as and when required, the attested photograph must be attached in the affidavit and they must ensure that they are properly represented by an Advocate.

4.Registry is directed to issue fresh order copy to the parties concerned.
