PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus, directing the 2nd and 3rd respondents to survey and mark the boundaries in the petitioner's land at Survey No.7/8 and Survey No.in No.7/9, Karaikadu Village, Aranthangi Taluk, Pudukkottai District on the basis of the representation given by the petitioner dated 30.04.2025 within a time stipulated by this Court. ORDER

The petitioner herein seeks a direction to the respondents 2 and 3 to consider his representation dated 30.04.2025 seeking survey of the property situated in Survey Nos.7/8 and 7/9 in Karaikadu Village, Aranthangi Taluk, Pudukkottai District.

2. Heard the arguments of Mr.S.Ramana, learned counsel appearing for the petitioner and Mrs.S.Jeya Priya, learned Government Advocate, who takes notice for the respondents 1 to 4. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

3. According to the petitioner, the subject property belongs to his wife Latha and patta stands in her name in Patta No.396. The petitioner had constructed a house in the subject property under the Government Welfare Scheme. The petitioner submitted a representation before the respondents 2 and 3 on 30.04.2025 seeking survey of the subject property. The same has not been considered. Hence, the petitioner has come before this Court.

The learned Government Advocate appearing for the respondents 1 to 4 would submit that patta for the subject property stands in the name of the petitioner's wife Latha and hence, if proper online application is filed in the name of the petitioner's wife, the same will be considered in accordance with law.

In view of the same, without expressing any opinion on the merits of the matter, the petitioner is directed to file proper online application for survey of the subject property through his wife and if any such application is filed, the same shall be considered by the second respondent in accordance with law and final orders shall be passed on its 3/6

own merits within a period of twelve (12) weeks from the date of receipt of the online application, after issuing notice to the petitioner, neighboring land owners and other interested parties.

6. With the above direction, this Writ Petition stands disposed of. No costs.
