Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying this Court to issue a Writ of Mandamus directing the respondents to take immediate action against the antisocial elements who have involved in uploading false and fake news against the petitioner based on his representation dated 11.07.2025 and facebook, Instagram and other social medias and punish them severely in accordance with law. ORDER

The petitioner claims that he is an Advocate and also Joint Secretary of a Political Party. He has filed this writ petition seeking a direction to take appropriate action as against the antisocial elements, who are uploding false and fake news against him, based on his representation dated 11.07.2025.

2.The learned counsel appearing for the petitioner submits that some false propaganda has been made as against the petitioner in order to tarnish his image and also to create communal clash in the area and therefore, he has preferred a complaint. However, there is no action and hence, the petitioner before this Court. The petitioner has also enclosed certain messages which are all received through social media. 3.The learned Additional Public Prosecutor appearing for the respondents submits that the petitioner has lodged a similar complaints before the Thoothukudi Cyber Crime Cell, Tirunelveli Cyber Crime Cell and Tirunelveli City Police Station. He further submits that the 3/6

petitioner is a resident of Madurai and he has preferred these complaints at Tirunelveli and Thoothukudi. The petitioner has not cooperated for the enquiry. 4.The Officer from Tirunelveli Cyber Crime Cell, who is present before this Court, submits that in the event if the petitioner surrender his mobile phone, then they can find out from which ID these messages have been spread and they can take necessary action. 5.Considering the above submission, this Court directs the petitioner to produce all his mobile phones to the sixth respondent and to co-operate for the enquiry. The sixth respondent is directed to find out whether this will lead to any communal clash in the area and register a case. If it is only a private dispute, then they need not proceed further. Accordingly, this writ petition is disposed of. No costs.
