PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the second respondent to dispose the appeal in Na.Ka.No.A1/5976/2022 and to issue separate patta in favour of Petitioner for her share of the property situated in Kandanoor Village, Survey No.71/11C, measuring 0.15.00 ares(42.5 cents), Sivagangai District based on the representation, dated 11.12.2024 within the time frame fixed by this Court.

O R D E R

The Petitioner herein seeks a direction to the second respondent to dispose the appeal in Na.Ka.No.A1/5976/2022 and to issue separate patta in the name of Petitioner in respect of the property situated in Kandanoor Village, Survey No.71/11C, measuring 0.15.00 ares(42.5 cents), Sivagangai District by considering his representation, dated 11.12.2024 2.Mrs.K.Malathi, learned Additional Government Pleader takes notice for the respondents 1 to 4. By consent of both parties,the Writ Petition is taken up for final disposal at the admission stage itself.

3.According to the Petitioner, the subject property originally belonged to his mother Alagammal. After the death of Petitioner's mother, patta for the subject property was mutated in the name of Petitioner's brother under whom the private respondents 5 to 7 are claiming right over the subject property. Therefore the Petitioner submitted an appeal before the second respondent seeking issuance of separate patta. The same has not been considered so far. Hence the Petitioner has come before this Court with the present Writ Petition for the relief stated supra. 4.Mrs.K.Malathi, learned Additional Government Pleader who takes notice for the respondents 1 to 4 would submit that the appeal filed by the Petitioner will be considered on its own merits within the time stipulated by this Court.

5.In view of the same, without expressing any opinion on the merits of the matter, the second respondent is directed to consider the appeal filed by the Petitioner in Na.Ka.No.A1/5976/2022 and dispose of the same after issuing notice to the Petitioner and private respondents 5 to 7, within a period of 12 weeks from the date of a copy of this order. 6.With the above directions, the Writ Petition stands 3/6

disposed of. No costs.
