The petitioners/Accused No.1 and 2, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Section 406 and 420 I.P.C., in Crime No.05 of 2023 on the file of the respondent police, seek anticipatory bail.

2. The learned Additional Public Prosecutor would submit that after completing the investigation, Final Report has been filed and it was taken cognizance by the learned Judicial Magistrate No.I, Tirunelveli in C.C.No.2160 of 2023, dated 04.09.2023. During the course of investigation, the petitioners appeared in pursuance of the notice issued under Section 41(A) of Cr.P.C.

3. Let the petitioners appear before the concerned trial Court and execute the bond under Section 88 of Cr.P.C. The trial Court is directed to refer the matter to the Mediation Centre for settlement, since repeatedly the defacto complainant requested this Court to refer the matter to the Mediation Centre, in view of the non recovery of money that is involved in the above said subject.
