Mr.B.Nambiselvan Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C. PRAYER:-For Anticipatory Bail in Crime No.155 of 2022 on the file of the Respondent Police.

ORDER: The Court made the following order:- The petitioners, who are arrayed as A2 and A3 apprehend arrest at the hands of the respondent police for the offences punishable under sections 406, 465, 468, 471 1/4

and 420 IPC, in Crime No.155 of 2023 on the file of the respondent police, seek anticipatory bail.

2.The case of the prosecution is brief:- The de-facto complainant lodged a complaint stating that A1 was introduced to him in 2021 in Marthandam. At that time, he stated that he is having contact with so many politicians and higher officials. He also assured to arrange jobs in the Central Government Departments. He introduced the above said A1 to several persons including his relatives. From several persons, several amounts have been deposited in the Bank Account of A1. In the course of time, the above said job arrangement was delayed. So, one of the victims namely one Stem stated that he wanted to go to Canada. So, the amount that was paid must be returned. But he could not collect the money from A1. So, he arranged money through loan and paid the same to the above Stem. Totally, Rs.

5,69,710/- was paid either cash or through Bank transactions. They have also sent fake appointment orders. They also joined in some of the posts. But later came to know that the above said postings are fake in nature. Upon which, a case in Crime No.155 of 2023 was registered for the offences under sections 406, 465, 468, 471 and 420 IPC. 3.

against them; The allegations have been made only against A1. 4.But the learned Additional Public Prosecutor would submit that during the course of investigation, the involvement of these petitioners also came to light and as per the statement of A1, it was found that only these petitioners created the above said fake appointment orders.

5.Perusal of the CD file shows that several fake appointment orders have been created in the name of the Central Government Departments and issued to various persons. When serious allegation has been made, the petitioners must be subjected to custodial interrogation to bring out the truth. 6.So, I find no reason to entertain this petition. The offence of this nature must be thoroughly investigated to bring out the truth.
