ORDER

This petition has been filed seeking for a direction to the 3rd respondent to take action on the petitioner's complaint in C.S.R.No.78/2026 dated 29.03.2026 as expeditiously as possible.

The learned counsel appearing for the petitioner submitted that the petitioner is the owner of a new Maruti Ertiga car bearing Registration No. TN-42-AH-4539, registered with the jurisdictional Regional Transport Office at Tiruchirappalli District. While so, the petitioner started receiving messages from certain toll plazas, including those situated in Madurai, indicating that the petitioner's vehicle had crossed the said toll plazas and that toll charges were being automatically debited from his account.

3. It was further submitted that a complaint in this regard was lodged before the respondent police on 16.03.2026, pursuant to which CSR No.78 of 2026 was issued on 29.03.2026. However, even thereafter, the petitioner continues to receive similar messages indicating alleged movement of the vehicle to various locations, resulting in repeated and unauthorised debits of toll charges from the petitioner's account. It is further submitted that despite the aforesaid complaint, no effective action has been taken by the respondent 2/6

police. Left with no other alternative, the petitioner has approached this Court by way of the present writ petition.

4. When the matter came up for admission on 25.06.2026, this Court had orally directed the third respondent police to file a report based on the representation and complaint made by the petitioner, as well as the further particulars submitted by the petitioner.

Today, when the matter was taken up for hearing, the learned Government Advocate appearing for the respondent police submitted that the vehicle bearing the petitioner's registration number has been traced in Thoothukudi District. It was further submitted that appropriate instructions have been issued to all the toll plazas concerned to keep track of the vehicle, identify the person using it, secure his photograph, and take necessary steps against the misuse of the petitioner's car's registration number. However, sofar no proper information has been received.

6. In response, the learned counsel appearing for the petitioner submitted that the said vehicle has crossed Thoothukudi District and entered the State of Kerala. It was further submitted that the petitioner continues to receive 3/6

messages indicating the movement of the said vehicle in the State of Kerala and that a sum of Rs.500 has also been debited from the petitioner's account towards fine in connection with the misuse of the petitioner's car's registration number.

7. Heard the learned counsel on either sides and carefully perused the materials available on record.

8. This Court finds that the grievance of the petitioner is serious in nature. If the said vehicle, which is alleged to be misused by the proposed accused, is involved in any criminal activity, the petitioner would unnecessarily be exposed to adverse consequences arising therefrom. In such circumstances, immediate and effective action is warranted.

9. Accordingly, the third respondent police is directed to forthwith take appropriate and expeditious action on the petitioner's complaint in CSR No.78 of 2026. The petitioner is directed to produce a copy of the Registration Certificate (RC) of the vehicle, along with relevant particulars, before the respondent police forthwith. The first respondent police is directed to monitor the investigation being conducted by the third respondent. The third respondent 4/6

police shall apprise the progress of the investigation to the first respondent every Friday.

10. It is further made clear that the third respondent police shall conclude the enquiry, trace out the person misusing the petitioner's car's registration number, and produce him before this Court on 15.07.2026.

11. With the above direction, this writ petition stands disposed of.

12. For producing the proposed accused, post the matter on 15.07.2026. 30.06.2026 NCC : Yes / No Index : Yes / No Note: Issue order copy on 01.07.2026.
