Respondents Prayer: Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus, directing the respondents to grant patta for the property in Survey no.155/5 an extent of 532 sq.fts in Kallikudi Village, Kallikudi Taluk, Madurai District by considering the petitioner's representation, dated 16.08.2023 within a period stipulated time by this Court.

ORDER

The present writ petition has been filed for a mandamus to direct the the respondents for issuance of patta in respect of property in Survey no.155/5 measuring an extent of 532 sq.fts in Kallikudi Village, Kallikudi Taluk, Madurai District by considering the petitioner's representation, dated 16.08.2023.

2. The grievance of the petitioner is that to date, steps have not been taken by the respondents to issue individual patta in favour of the petitioner taking into account the partition that has been entered into between the petitioner and his brother on 17.03.2011 under a registered partition deed. Tha patta continues to be in the joint name of the petitioner and his brother.

3. Considering the above request and taking note of the partition that has been effected, the 1st respondent is directed to take steps to grant

patta after affording an opportunity to the petitioner as well as his brother. The petitioner shall produce all the documents so as to enable the 1st respondent to take steps for issuance of patta. The 1st respondent shall pass orders within a period of six (6) weeks from the date of receipt of copy of this order.

4. With the above directions, this Writ Petition stands allowed. No costs.
