This Petition is filed to condone the delay of 449 days in filing the above Civil Miscellaneous Appeal as against the award made in M.C.O.P.No.81 of 2018, dated 1.11.2023 on the file of the Motor Accidents Claims Tribunal/Additional Sub Court, Karur.

2.Heard the learned counsel appearing on either side and perused the materials placed before this Court. The learned counsel for the second respondent has no objection in allowing this Petition on condition that the Petitioner is not entitled for interest for the delay period. The learned counsel for the appellant filed a memo stating that R2 was set ex-parte before the Tribunal in the claim petition and his appearance may be dispensed with. The said memo is recorded and service of notice on R1 is dispensed with, as per the request made by the learned counsel for the Petitioner.

3.For the reasons stated in the accompanying affidavit filed in support of the Petition and on being satisfied with the same, this Petition is allowed and the delay is condoned, however, on condition that the Petitioner/claimant is not entitled for interest for the delay period.

4.Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise in order and list it for admission in the usual course. 18.09.2025 vsn 2/3
