Mr.D.Ramesh Kumar, Advocate for R1 to R3 Prayer : Civil Miscellaneous Petition is filed seeking an order of stay of all further proceedings in pursuance of the order dated 22.11.2024 made in M.C.O.P.No.390 of 2024 on the file of the Motor Accident Claims Tribunal (Special District Judge), Thanjavur, pending disposal of the above appeal.
ORDER
Heard the learned counsel for the petitioner.
2. Mr.D.Ramesh Kumar, learned counsel, appeared on behalf of respondent Nos.1 to 3.
3. The learned counsel for the petitioner submitted that the petitioner has already deposited the entire award amount, along with the accrued interest and costs, in M.C.O.P.No.390 of 2024 before the Special District Court, Thanjavur. To that effect, he has also filed an additional typed set of papers producing a copy of the deposit receipt. 2/5
4. The learned counsel for respondent Nos.1 to 3 conceded the submission made by the learned counsel for the petitioner and prayed that respondent Nos.1 to 3 / claimants 1 to 3 may be permitted to withdraw 50% of the deposited amount.
5. The learned counsel for the petitioner submitted that the admitted liability of Rs.18,20,000/- (Rupees Eighteen Lakhs and Twenty Thousand only) may be permitted to be withdrawn by the claimants.
6. In view of the fact that the petitioner has already deposited the entire award amount, there shall be an order of stay till the disposal of the Civil Miscellaneous Appeal in C.M.A.(MD)No.253 of 2026.
7. Considering the facts and circumstances of the case, this Court is inclined to permit respondent Nos.1 to 3 / claimants 1 to 3 to withdraw the admitted liability of Rs.18,20,000/- (Rupees Eighteen Lakhs and Twenty Thousand only), along with the accrued interest and costs. Accordingly, respondent Nos.1 to 3 / claimants 1 to 3 are permitted to withdraw the sum of Rs.18,20,000/- (Rupees Eighteen Lakhs and Twenty 3/5
Thousand only), along with the accrued interest and costs, as apportioned by the Tribunal, by filing the necessary application before the Special District Court, Thanjavur.
