For Respondent : Mr.S.Manikandan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime no.82 of 2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/accused who apprehends arrest at the hands of the respondent police for the offences punishable under sections 147, 148, 294(b), 323, 324, 506(ii) of I.P.C. and Section 4 of TNPHW Act, 2002, in Crime No. 82 of 2023 on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that the defacto complainant made a complaint stating that one Erulappan and Marimuthu had made verbal arguments with drunken mood against the defacto complainant's brother Muthu Raja. Based on the motive on 21.05.2023 at about 5.00 p.m. the accused person attacked the defacto complainant and his family members.
3.The learned counsel for the petitioner would submit that the petitioner is an innocent person. There is a case in counter case. 4.The petitioner was already granted anticipatory bail in Crl.O.P.(MD).No.9720 of 2023 on 06.06.2023 with some conditions. The learned counsel for the petitioner would submit that because of his inability to comply the above said condition, the above said order got lapsed. Therefore, he filed this application. 5.When the petitioner was granted anticipatory bail, then second petition will not lie. There is no question of granting second anticipatory bail.
