ORDER

Seeking to direct the respondents 1 to 2 to conduct proper investigation and to take action against 4th and 5th respondents, considering the petitioner's representation, dated 27.07.2025, this writ petition is filed.

2. Since no adverse order is passed against the private respondents, notice to the private respondents is dispensed with.

The learned counsel for the petitioner submitted that the 4th and 5th respondents had availed a loan from Tata Capital to a tune of Rs.45,00,000/- (Rupees Forty Five Lakhs only), for which the 4th respondent had fraudulently executed certain documents in favour of the company with respect to the property belonging to the petitioner, and now the property has been brought for auction illegally. In this regard, a representation has been made before the respondent police on 27.07.2025. Since no action has been taken, the petitioner is before this Court.

4. The learned Government Advocate(Crl.side) on instructions submitted that the representation was submitted before one year. In fact, the petitioner as well as the 4th and 5th respondents were friends who had jointly availed loan by pledging the petitioner's property with Tata Capital. In this regard, due to default of loan, SARFAESI proceeding has been initiated and the petitioner's property has been brought to auction. In this regard, enquiry has been conducted and the same was closed on 17.08.2025.

5. Recording the submission of the learned Government Advocate(Crl.side), giving liberty to the petitioner to file a private complaint, this writ petition is disposed of.
