PRAYER : Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus directing the respondents to permit the petitioner to serve the idol of Goddess "Arulmigu Patatharasi Amman" and allow the petitioner to perform pooja and customary devotion and to hand over the temple possession and maintenance to the petitioner. O R D E R

This Writ Petition is filed praying for a mandamus directing the respondents to permit the petitioner to serve the idol of Goddess "Arulmigu Patatharasi Amman" and allow him to perform pooja and customary devotion and to hand over the temple possession and maintenance to the petitioner.

2. The learned Additional Government Pleader appearing for the Respondents 1 to 3 has produced proceedings dated 03.09.2022 of the 3rd Respondent to the 2nd Respondent recommending rejection of the prayer/request made by the petitioner vide representation dated 17.09.2021.

3. When the matter was taken up for hearing, the learned counsel appearing for the petitioner seeks permission of this Court to withdraw this petition, with liberty to challenge the communication, dated 03.09.2022.

4. In view of the submission made by the learned counsel for the petitioner and also considering the subsequent development, this Writ Petition is dismissed as withdrawn. The petitioner is at liberty to challenge the proceedings dated 03.09.2022 in the manner known to law. No costs.
