ORDER
The petitioner herein seeks a direction to the respondent to transfer patta for the property situated in Survey No.2085/7P, measuring 2.44 acres in Allinagaram Village, Theni by considering his representation dated 29.05.2025.
2. Heard the learned counsel appearing for the petitioner and Mr.M.Gangatharan, learned Government Advocate who takes notice for the respondents.
3. By consent of both the parties, the writ petition is taken up for final disposal at the stage of admission itself.
4. According to the petitioner, the subject property is the ancestral property of one Subbiah Naidu. He executed a registered settlement deed in favour of his elder son namely S.Thulasiraman on 10.07.1997. The other son of Subbiah Naidu namely Mohan relinquished his share in the subject property. Subsequently, the petitioner purchased the subject 2/6
property from one Prema (wife of S.Thulasiraman) under a registered Sale Deed dated 12.03.1999. However, wife of Subbiah Naidu namely Jeyalakshmi appeared to have created the registered sale agreement.
5. Now, the petitioner submitted a representation on 29.05.2025 seeking transfer of patta based on the registered sale deed dated 12.03.1999, executed by Prema (wife of S.Thulasiraman) in favour of the petitioner. The same has not been considered. Hence, the petitioner has come before this Court.
6. The learned Government Advocate appearing for the respondent would submit that the petitioner has not filed proper online application. Therefore, the representation submitted by him has not been considered.
7. In view of the same, the petitioner is directed to submit proper online application before the respondent with all supporting documents within a period of two (2) weeks from the date of receipt of a copy of this order. On submission of such application, the respondent shall consider the same and pass final orders on its own merits within a period of forteen 3/6
(14) weeks after issuing notice to the petitioner, legal heirs of Subbiah Naidu, S.Thulasiraman and other interested parties.
8. The writ petition is disposed of with the above observations. No costs.
