Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus to direct the respondents to take necessary steps to issue the patta in favour of the petitioner in respect of her property comprising in New Natham survey No.616/1 (old No.277/36) an extent of 4661 1⁄4 in 2nd street, Parthibanur Town, Paramakudi Taluk, Ramnad District based on the petitioner's representation dated 17.06.2014. ORDER
This writ petition has been filed for the issue of a writ of mandamus directing the respondents to act upon the representation made by the petitioner on 17.06.2014, wherein the petitioner is seeking for patta in her name with respect to the subject property. 2.The case of the petitioner is that the subject property originally belonged to one Selvamani and Govindarajan and they executed a power of attorney in favour of the husband of the petitioner. There was some civil proceedings initiated and some went in their favour and it was also confirmed in the appeal. Thereafter the property was sold in favour of the petitioner under registered sale deed dated 21.08.2019. This again became the subject matter of challenge before the civil Court and the suit was 1/3
dismissed and it was further confirmed in the appeal. 3.The petitioner made a representation to the respondents seeking for patta in her favour. Since the same was not considered, the present writ petition has been filed before this Court. 4.Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing on behalf of the respondents.
5. Taking into consideration the facts and circumstances of the case and the limited relief sought for in this writ petition, there shall be a direction to the second respondent to consider the representation made by the petitioner on 17.06.2014 strictly in accordance with law and pass orders within eight weeks from the date of receipt of a representation from the petitioner. If the second respondent finds that there is any other party, who is interested in the subject property, notice shall be issued before taking a final decision.
6. The petitioner is directed to make a fresh representation to the second respondent enclosing all the relevant documents along with a copy of this order.
7. The writ petition is disposed of with the above direction. No costs.
