PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the 1st respondent to grant the remaining amount of Rs.67,732/- towards medical reimbursement to the petitioner for his wife's treatment, by considering the petitioner's representation, dated 12.07.2024.

ORDER

The instant Writ Petition has been filed by a retired Government servant, seeking reimbursement of medical expenses incurred for his wife.

2. Even though the petitioner has made a request for reimbursement of Rs.1,62,107.74, the second respondent Insurance Company has disbursed only a sum of Rs.94,375/-. However, the petitioner has addressed a communication to the second respondent on 12.07.2024, requesting for reimbursement of the balance amount.

3. Learned Standing Counsel, appearing for the second respondent Insurance Company, submits that whatever amount the petitioner is eligible to, the said amount has already been disbursed and the petitioner is not eligible for any further sum.

4. Considering the above said facts, the second respondent Insurance Company is directed to pass orders to the above said effect, so that the same could be challenged before the District Level Empowerment Committee, by the writ petitioner.

5. Writ Petition is disposed of accordingly. No costs. 21.08.2024 NCC :
