O R D E R
The petitioner, who apprehends arrest at the hands of the 1/5
respondent police for the offence under Section 303(2) of BNS Act, 2023, r/w Section 21(1) of Mines and Minerals (Development & Regulations) Act, 1957, in Crime No.187 of 2026, on the file of the respondent Police, seeks anticipatory bail.

The allegation against the petitioner is that, on 06.06.2026 at about 05.00 a.m., A1 was found illegally transporting 4 gunny bags of river sand from the Cauvery River in a TVS XL 100 motorcycle, which did not bear any registration number. It is further alleged that, while the said sand was being loaded into a Bolero pick-up vehicle belonging to the petitioner, the officials intercepted the vehicles and seized the sand along with the vehicles. Consequently, the present case came to be registered against the accused.

The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any such offence as alleged by the prosecution and he has been falsely implicated in this case. He would further submit that the petitioner has no connection with A1. and A1 is already arrested and released on bail. Hence, he prays to grant 2/5
anticipatory bail to the petitioner.
4. The learned Government Advocate (Criminal Side) appearing for the respondent reiterated the prosecution case and submitted that the petitioner is arrayed as A2. According to the statement recorded from A1, he had received a sum of Rs.15,000/- from the petitioner for illegally quarrying sand, and while the sand was being transported, it was seized by the officials. It was further submitted that the petitioner had played an active role in the alleged occurrence and is the owner of the vehicle involved in the offence. The amount of Rs.15,000/- allegedly received by A1 was also seized along with the vehicle loaded with sand. Since the investigation is still in progress, he opposed to grand anticipatory bail to the petitioner.

Considering the above facts and circumstances of the case, and statement recorded from A1 reveals that the petitioner is the main accused and there is a clear submission against him and he also caused damage to the ecology and water body, this Court is not inclined to grant anticipatory bail to the petitioner.
