Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondent Nos.1 to 3 to provide electricity connection to the petitioner's house situated in the survey No.246/3A2 at Marungoor Village, Thiruvadanai Taluk, Ramanathapuram District based on the petitioner's application, dated 17.06.2025 within stipulated time fixed by this Court. 1/5

ORDER

This Writ Petition is disposed of at the time of admission after hearing the learned counsel for the petitioner and the learned Standing Counsel for the respondent Nos.1 to 3 and after dispensing with the notice on the private respondent Nos.4 to 6 as there is no proposal to pass any adverse order.

This Writ Petition has been filed seeking a Mandamus, to direct the respondent Nos.1 to 3 to provide electricity connection to the petitioner's house situated in the survey No.246/3A2 at Marungoor Village, Thiruvadanai Taluk, Ramanathapuram District based on the petitioner's application, dated 17.06.2025.

3. In the process of putting up a construction, the petitioner had applied for a power connection. He had requested the respondents to shift the high tention wire, which is currently above the proposed construction, which is being 2/5

put up by the petitioner on his patta land. Since, the high tension wire is above the proposed construction, he had requested the respondent Nos.1 to 3 to shift the alignments. He had paid the necessary charges. Pursuant to which, the official respondents have also erected two poles, which, according to the official respondents, it is on the patta land of the petitioner. However, the respondent Nos.5 and 6 are objecting to the same stating that the poles have been erected on their patta land and high tension wire will criscross over their patta land.

4. The private respondents appear to be the owner of the adjacent lands, above which, the high tension wire line is expected to be diverted.

5. The official respondents shall consider the objections raised by the private respondents as well as the request made by the petitioner, after causing the land to be surveyed by the land Surveyor.

6. Under these circumstances, liberty is given to the petitioner to approach the land surveyor for surveying his land. Survey of the land shall be conducted in the presence of the petitioner and private respondents. Thereafter, the official respondents shall take steps to shift 3/5

the high tension wire, which currently in the above construction of the petitioner.

7. With the above directions and liberty, this Writ Petition is disposed of. No costs.
