PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents to grant permission and necessary protection to conduct the Adal Padal Programme on 6.9.2022 at 6.00 PM to 11.00 PM in connection with Varudaabiseka Thiru Vizha of Arulmigu Sri Guruayyanar and Kaliamman Thirukovil at Guruvandan Street, Kallakkottai Post, Kandarvakottai Taluk, Pudukkottai District. 1/5

O R D E R

This Writ Petition has been filed seeking issuance of a writ of mandamus directing the Respondents to grant permission and necessary protection to conduct the Adal Padal Programme on 6.9.2022 at 6.00 PM to 11.00 PM in connection with Varudaabiseka Thiru Vizha of Arulmigu Sri Guruayyanar and Kaliamman Thirukovil at Guruvandan Street, Kallakkottai Post, Kandarvakottai Taluk, Pudukkottai District.

2. The term 'Adal Padal ' is not at all connected with spirituality by Singing devotional songs in the temple premises, either it relates to Goddess Mariamman, Lord Muruga, Lord Vinayaga or Lord Siva. does not attract Law and Order Issues. Law and order problem will arise by the term 'Cultural activities'. There had been past incidents resulting in law and order problem based on the so called 'cultural programs' which are not at all related to devotional songs or spirituality. Some other programmes which attracts the provisions of Section 294(b) IPC which, in turn, causes law and order dispute between groups in villages which 2/5

had invited the Director General of Police to issue Circular restricting this sort of so called 'cultural programs'. This Writ Petition is filed seeking permission of this Court against the direction issued by the Director General of Police.

2A. In this case, the District Collector of Pudukottai District is impleaded Suo motu as a proper and necessary party as District Magistrate of the District concerned dealing with Law and Order issues.

3. This petition is disposed of with a direction to the District Collector concerned to pass appropriate orders.
