Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 to 4 to prevent the 6th respondent from illegally laying the road in survey No.114/2 situated at Kulasekarankottai Village, Vadipatti Taluk, Madurai District.

ORDER

Heard the learned counsel for the writ petitioner and the learned Additional Government Pleader for the respondents 1 to 4. Considering the nature of relief to be granted, issuance of notice to the respondents 5 and 6 is dispensed with.

2.The learned Additional Government Pleader for the respondents 1 to 4 clarifies that the Government has no proposal as of now to lay any road in the petition mentioned survey number ie., S.No.114/2. If any such proposal is mooted tomorrow, the petitioner will be duly informed in advance. Since the stand of the official respondents has been clarified, no cause of action survives against them. The petitioner cannot seek relief against private respondents in 2/4

this writ petition. He has to avail his remedy elsewhere in the manner known to law.

3.With this liberty to the writ petitioner to claim relief against the private respondents, the writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
