ORDER
The present Writ Petition has been filed for the issuance of a Writ of Mandamus to direct the respondents 1 and 2 to conduct enquiry upon the petitioner objection petition dated 24.02.2025 and pass order upon the petitioner objection and entered in index maintained by the 2nd respondent.
2. The petitioner entered into a sale agreement with the 3rd respondent. However, without fulfilling the terms of the agreement, the 3rd respondent executed a settlement deed in favor of the 4th respondent. Therefore, the petitioner submitted an objection petition to the 2nd respondent along with the parent document of the disputed property. However, the 2nd respondent neither considered the petition nor took any action but keeping it pending.
3. The learned counsel appearing for the petitioner submitted that the parent document was handed over to the petitioner by the 3rd respondent, and further, the petitioner is in possession of the property. This submission is recorded.
4. Taking all these facts into consideration, the appropriate remedy for the petitioner lies before the competent civil court. Accordingly, the petitioner is directed to approach the civil court along with a petition for interim relief 2/4
against respondents 3 and 4, within a period of eight weeks from the date of receipt of a copy of this order.
4. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
