ORDER

Seeking to direct the respondents 1 to 4 to permit the petitioner and the villagers to participate in the temple festival and observe all events of Arulmigu Muneeswarar Temple and the following sub temple situated in Anaiyur, Karumakavundampatti, Sundakkampatti, Manapaarai Taluk, Trichy District in the ongoing temple festival which is commenced from 26.06.2026 and will continue till 01.07.2026, this writ petition is filed.

2. The learned counsel for the petitioner submitted that already the 5th respondent had filed a writ petition before this Court in W.P.Crl.(MD)No.3315 2/6

of 2026 seeking to direct the respondent police to provide adequate police protection for conducting the temple festival in the subject temple of this writ petition. Pursuant to which, the respondent police, without putting the parties as directed by this Court on notice under Section 64 BNSS, had directly called the parties through phone to attend an enquiry. Since no summons were issued, the petitioner did not appear before the respondent police. As a result of which, resolution was not arrived at before the respondent police. Thereafter, a peace committee was conducted by the Tahsildar, Manaparai Taluk between the rival parties on 24.06.2026.

However, the 5th respondent group had failed to cooperate in arriving at a proper resolution, facilitating the participation of all parties in the temple festival, and had walked out of the peace committee meeting. Pursuant to which, the said peace committee had concluded as a failure meet and the same was recorded in proceedings bearing Na.Ka.No.A2/3094/2025, dated 24.06.2026 only because of the mala fide attitude of the 5th respondent group, the peace committee conducted by the Tahsildar, Manapparai Taluk had failed and thereafter, the petitioner group is prevented by the 5th respondent group from participating in the temple festival.

3. Heard the learned counsel on either side and carefully perused the materials available on record.

4. In this regard, it is made clear that the 5th respondent should not prevent the petitioner and other villagers from participating in the temple festival by all means. It is made clear that, none of the rival parties should seek any first honour during the temple festival. The 4th respondent police is directed to ensure that all the villagers, including the petitioner and his family members, are participating peacefully in the temple festival. It is made clear that, any untoward incident reported, it would be the responsibility of the 5th respondent.

5. With the above directions, this Writ Petition stands disposed of. 25.06.2026 NCC : Yes / No Index : Yes / No gbg Note : Issue order copy on 25.06.2026.
