PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the respondents that to permit the petitioner to grant permission for celebrating the Vinayagar Chathurthi Festival conducted function of Arulmigu Arasu Vinayagar Kovil at K.Neduvayal, Singampunari Taluk, Sivagangai District, and to give adequate police protection for the procession and immerse of Vinayagar Idol scheduled to be held on 02.09.2022 by considering the representation dated 30.08.2022. 1/5

O R D E R

This writ petitioner filed this Writ Petition seeking for issuance of a Writ of Mandamus, directing respondents to permit the petitioner to grant permission for celebrating the Vinayagar Chathurthi Festival conducted function of Arulmigu Arasu Vinayagar Kovil at K.Neduvayal, Singampunari Taluk, Sivagangai District, and to give adequate police protection for the procession and immerse of Vinayagar Idol scheduled to be held on 02.09.2022 by considering the representation dated 30.08.2022.

2. Heard Mr.K.Dinesh, learned counsel appearing for the petitioner and Mr.M.Sakthi Kumar, learned Government Advocate (Criminal Side), appearing for the respondents.

3. The learned Government Advocate (crl. side) appearing for the respondent police submitted that there is no installation of Vinayagar idol, as stated by the petitioner and disputed the fact itself. He further submitted that the installation of the idol as stated by the petitioner is not 2/5

in the place and that there is no representation received from the petitioner by the 3rd respondent/Inspector of police. The statement is recorded.

4. The learned counsel appearing for the petitioner disputed that there is no ideol was installed and they are going to conduct procession and immerse of Vinayagar Idol scheduled to be held on 02.09.2022. The statement is recorded.

5. Recording the same, the 3rd respondent/Inspector of Police is directed to verify that whether the idol was installed as stated by the petitioner and if installed, consider the representation of the petitioner, dated 30.08.2022 and permit the petitioner to conduct idol procession through the non-problematic area as marked by the respondent police.

6. With the above direction, this writ petition is disposed of. No cost.
