ORDER
The petitioner, who is the defacto complainant in Cr.No.495 of 2012 on the file of the second respondent Police, has filed this petition seeking a direction to the second respondent Police to complete the investigation in the said case and file a final report, within a time frame. 2.The learned Government Advocate(Crl.side) appearing for the respondents submits that the investigation in this case completed and the same was closed as 'Mistake of Fact', on 02.07.2018 itself. However, the learned Government Advocate(Crl.side) is not having any instructions as to whether RCS notice was served or not on the petitioner. 3.Since the case itself was closed as 'Mistake of Fact', this Court is not inclined to entertain this petition. The petitioner is at liberty to challenge the final report, provided if he is having any grounds and the learned Judicial Magistrate, Tenkasi shall entertain the protest petition, if the petitioner has not been served with RCS notice. Accordingly, this criminal original petition is closed.
