Seeking police protection, the petitioner has filed this Criminal Original Petition.
2.The learned counsel for the petitioner submits that the petitioner has parted with a sum of Rs.3,00,000/- to the third respondent for purchase of a house plot, however, the third respondent has neither bought a house for the petitioner, nor returned the money. Moreover, the third respondent has abused the petitioner and criminally intimidated. Apprehending danger at the hands of the third respondent, the petitioner has approached this Court, seeking police protection. 3.Mr.P.Kottaichamy, learned Government Advocate (Crl.side), who takes notice for the respondents 1 & 2 submits that this petitioner has lodged a similar complaint as against the third respondent, before the respondent police on 07.06.2023 that the third respondent has received a sum of Rs.1,00,000/- from this petitioner and has cheated him and the same was treated as a petition enquiry in CSR No.76 of 2023 and it was closed as the issue is civil in nature. Thereafter, this petitioner has lodged another complaint as against the third respondent in the year 2025 2/6
that he is harassing and he is posing threat. In the present complaint, the petitioner has taken a stand that the third respondent has received a sum of Rs.3,00,000/- for purchasing a plot and cheated. The present complaint is treated as a petition enquiry in CSR No.64 of 2025 and the petitioner is not co-operating for the enquiry. The learned Government Advocate, has produced a copy of the earlier complaint of the petitioner, dated 07.04.2023.
4.This Court considered the rival submissions made and also perused the materials placed before this Court. 5.It appears that the petitioner has lodged a complaint even in the year 2023 that the third respondent has cheated a sum of Rs.1,00,000/- from him. In the year 2025, the petitioner has lodged another complaint that he has parted with a sum of Rs.3,00,000/- to the third respondent and he has cheated and also filed this petition, seeking police protection. Even in the affidavit filed in support of this petition, the petitioner has not stated anything about his previous complaint, dated 07.04.2023 as against the third respondent.

6.Considering the manner, in which, the petitioner has approached this Court, by suppressing the earlier complaint, dated 07.04.2023, this Court is inclined to dismiss this petition with a cost. 7.Accordingly, this Criminal Original Petition is dismissed with a cost of Rs.10,000/-, which has to be paid by the petitioner to the second respondent police station and the amount shall be utilized for the welfare activities of the said police station. 18.07.2025 NCC : Yes/No Index : Yes/No Internet:Yes vrn 4/6
