O R D E R
The petitioner has filed this Writ Petition for the issuance of a Writ of Mandamus, directing the first respondent to reissue/renew the passport bearing No.M1414402 to the petitioner by processing his application in File No.TR1077228465124, based on the petitioner's application dated 19.12.2024.
2. The petitioner is the holder of Passport No.M1414402, which expired on 24.08.2024. The petitioner had filed an application for renewal and re-issuance of the passport on 19.12.2024. It is clear that the application was filed only after the said passport had expired.

The learned Government Advocate appearing for the second respondent police submits that the petitioner is arrayed as A2 in Crime No.94 of 2022, registered by the second respondent police for the alleged offences punishable under Sections 294(b), 352, 427, and 506(ii) of the Indian Penal Code, 1860.

4. It is submitted that the charge sheet was also filed before the Judicial Magistrate Court, Pappanasam, as early as 30.01.2024, and the same has not yet been taken on file.
5. Considering the same, there can be no impediment in directing the first respondent to process the petitioner's application for renewal and re-issuance of the passport. Accordingly, the first respondent is directed to process the petitioner's application for renewal/issuance of the passport and issue a passport, preferably, as expeditiously as possible, within a period of six weeks from the date of receipt of a copy of this order.
6. However, the petitioner shall suo motu surrender the passport before the Judicial Magistrate Court, Pappanasam, as and when the charge sheet is taken on file against the petitioner.
7. It is open to the second respondent police to take steps to seize the passport of the petitioner and deliver the same before the Judicial Magistrate Court, Pappanasam, as and when the charge sheet is taken on file against the petitioner in the criminal case registered against him Page No. 3 of 5
pursuant to the aforesaid Crime No. 94 of 2022, in case the petitioner fails to voluntarily surrender the passport before the said Court.
