Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to grant permission to the petitioner to withdraw the deposited amount of Rs. 1,00,000/- to the credit of C.C.No. 239/2013 on the file of Judicial Magistrate, Fast Track Court at Magisterial level, Karur, order by this court in Crl.RC No. 44 of 2016 dated 02.02.2016 and thus render justice.

Prayer in CRL RC(MD) No.44/ 2016:

Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to call for the entire records relating to the order of the judgement by the Principal Sessions Judge, Karur dated 02.11.2015 in CA.No.1 of 2015 for modifying the judgement passed in CC No.239 of 2013 on the file of Judicial Magistrate Fast Track Court at Magisterial Level, Karur by judgement dated 09.12.2014 and set aside the same by allowing the present Criminal Revision Petition. Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.S.VIJAYASHANTHI, Advocate for the petitioner and of M/S.S.KARTHIK, on behalf of the Respondent, the court made the following order:- This Criminal Miscellaneous Petition has been filed by the Complainant seeking grant of permission to the Complainant to withdraw the deposited amount of Rs.1,00,000/- to the credit of C.C.No.239/2013 on the file of the learned Judicial Magistrate, Fast Track Court at Magisterial Level, Karur.

2. This Court, while entertaining the Criminal Revision Case,

CRL MP(MD) No.3178 of 2018 vide order dated 02.02.2016, directed the accused/revision petitioner to deposit a sum of Rs.1,00,000/- (Rupees one lakh only) to the credit of C.C.No.239 of 2013 on the file of the learned Judicial Magistrate, Fast Track Court at Magisterial Level, Karur, within a period of three weeks. Pursuant to the said direction, the accused/revision petitioner has also deposited a sum of Rs.1,00,000/- before the trial Court.

3. Today, when the matter is taken up for hearing, the learned counsel for the petitioner submits that he is not having any objection for allowing this petition.

4. In view of the no objection having been made by the learned counsel for the accused/revision petitioner, this Crl.M.P.(MD) No.3178 of 2018 is allowed. The Complainant is permitted to withdraw the deposited amount.
