ORDER

The petitioner appears to have sustained injury in an accident and lodged a complaint dated 11.12.2023 before the respondent Police that a Car, bearing Reg.No.TN67 BJ 7083, hit his two wheeler and caused the accident. He was admitted as in-patient and has taken treatment for a period of 20 days. Now, the petitioner, with a grievance that his complaint has not been enquired by the respondent Police, has filed this petition seeking a direction to the respondent Police to take action based on his complaint dated 11.12.2023.

2. The learned Government Advocate (Crl. Side), on instructions, submits that the driver of the car has lodged a complaint, based on which, a case in Crime No.359 of 2023 was filed as against the petitioner for the offence under Sections 279 and 337 IPC. According to him, they have enquired the petitioner's complaint and found that the petitioner is responsible for the accident. Therefore, they have closed the complaint of the petitioner and filed the final report as against the petitioner before the learned Judicial Magistrate No.II, Dindigul and the same is also taken on file in STC No.2328 of 2023.

3. This Court considered the rival submissions made.

4. The petitioner claims that the complainant in Crime No.359 of 2023 is the person caused the accident. On the other hand, the respondent Police has filed the final report as against the petitioner that he is the person caused for the accident. It is also reported that the final report has already been filed before the concerned Court and it has been taken on file in STC No.2328 of 2023.

5. Therefore, this writ petition is closed with a direction to the respondent Police to furnish a copy of the closure report of the petitioner's complaint dated 11.03.2023 to the petitioner enabling him to workout his remedy in the manner known to law. The petitioner is at liberty to take all his defence in STC No.2328 of 2023. No costs. 05.08.2025 ogy NCC : Yes / No.
