PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the fourth respondent to consider the petitioner's representation dated 17.07.2023 and to provide adequate police protection for peaceful conduct of the temple festival to be conducted on 03.08.2023 to 05.08.2023 at Arulmigu Guruvachiammal Thirukovil, T.V.Renganathapuram, Andipatti Taluk, Theni District. O R D E R

This Writ Petition is filed seeking for a direction to the respondent Police on the basis of a representation given by the petitioner on 17.07.2023 to provide suitable protection to the petitioner for conducting temple festival from 03.08.2023 to 05.08.2023 at Arulmigu Guruvachiammal Thirukovil, T.V.Renganathapuram, Andipatti Taluk, Theni District.

2. Heard learned counsel for the petitioner.

3. Learned Additional Public Prosecutor has submits that there are disputes between the petitioner and other rival group in respect of the poojari-ship and other management of the temple. A civil suit in O.S.No.74 of 2011 was filed before the learned District Munsif, Andipatti, in respect of the said dispute and the same was stated to be dismissed. Aggrieved by the same, A.S.No.11 of 2023 was filed and the same is pending. It is further submitted by learned Additional Public Prosecutor that so far as conducting of festival this year is concerned, a Peace Committee Meeting was convened by the Tahsildar with all the parties concerned, wherein, a decision was taken on 28.07.2023 to the effect that this year, all the parties concerned would perform the festival together by maintaining peace.

4. In view of the above, this Writ Petition is disposed of, directing the respondent Police to provide suitable protection for conducting of the festival basing on the resolution passed in the Peace Committee meeting. No costs.
