For Respondent : Mr.R.Meenakshi Sundaram, Additional Public Prosecutor PETITION FOR BAIL Under Sec.439 of Cr.P.C PRAYER :- For Bail in Crime No.24 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/Sole Accused, who was arrested and remanded to judicial custody on 29.09.2021 for the offence under Sections 406, 417, 420, 294(b) and 506(i) IPC in Crime No.24 of 2021 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner is said to have received a sum of Rs.4,70,000/- from the defacto complainant by giving false promise that he would arrange Government job in the Agricultural Department and thereafter, he failed to secure the job and refused to return the said amount. Hence, the complaint.

3.The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner is in judicial custody from 29.09.2021 and hence, he seeks for grant of bail.

4.The learned Additional Public Prosecutor appearing for the respondent police would submit that it is a case of job racketing and the petitioner is said to have received a sum of Rs.4,70,000/- from the de-facto complainant for getting Government job. CRL OP(MD). No.16849 of 2021 23.07.2019, during enquiry before the respondent police, the petitioner has agreed to pay a sum of Rs.50,000/- to the defacto complainant and undertook that he will pay the remaining amount within three months. But he did not repay the balance amount till date and cheated the de-facto complainant. He would further submit that the investigation is pending and hence, he strongly opposed for grant of bail to the petitioner.

5.Considering the seriousness and gravity of the offences alleged against the petitioner and also the facts that the petitioner has not repaid the remaining amount till date and that the investigation is pending as stated by the learned Additional Public Prosecutor, this Court is not inclined to grant bail to the petitioner at this point of time.
