1.The District Collector, Dindigul, 2.The Assistant Executive Engineer, Public Works Department, Water Resources Department, Marudhanadhi Basin Sub Division, Nilakottai, ... Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the respondents to grant appointment order to the petitioner on the compassionate grounds. ORDER
Heard the learned counsel on either side.
2. The petitioner's father died in harness on 17.01.1998. The petitioner's elder brother Anandhan was given appointment on compassionate ground. The said Anandhan died in harness on 29.04.2018. The petitioner seeks appointment on compassionate ground.
3. The petitioner is aged about 47 years. The object of providing compassionate appointment is to enable the dependent family to tide over the crises. By no stretch of imagination, the petitioner can be called as a dependent member. A 47 years old able-bodied individual cannot be treated as a dependent member. Looked at from any angle, the petitioner has not made out a case for appointment on compassionate ground.
4. The Writ Petition is dismissed. No costs. 05.09.2022 Index : Yes / No Internet : Yes/ No rmi To 1.The District Collector, Dindigul, 2/4
