ORDER

Challenge has been made to the impugned order of the 2nd respondent in Na.Ka.No.2248/ThaPi/2022, dated 12.07.2022 and 3rd respondent in Na.Ka.No. 8276/E4/2021, dated 22.03.2022, in and by which, the third respondent has given a finding that the registration is a fraudulent registration and on appeal before the 2nd respondent, the 2nd respondent has also confirmed it.

2. The petitioner purchased the property in the year 2008 and sale has been executed by the 7th respondent as a partner of St. Abraham Firm promoters a land promoter. Thereafter a complaint has been given by the respondent No.6 stating that the power of attorney granted in favour of the 7th respondent has been cancelled as early as on 18.02.2008 on which date, the 7th respondent had executed a sale deed in 2/5

favour of the petitioner for the two items of property out of 6. Based on that complaint, it is held that the document has been fraudulently registered.

3. On going through the impugned order, it is seen that the order has been passed without any discussion and without recording any evidence. Hence, this Court is of the view that the order cannot be sustained in the eye of law. That apart, the Apex Court in Satya Pal Anand v. State of M.P.[ 2016 10 SCC 767], and this Court in G. Rajasulochana v Inspector General made in W.P 29706 of 2024 dated 16.04.2024, had elaborately dealt with the issue of fraudulent registration. Therefore, it is for the parties to work out their remedy before the competent civil court. Accordingly, (*)this Writ petition is allowed. No costs. Consequently connected Miscellaneous Petition is closed.
