ORDER

This Criminal Original Petition has been filed to direct the learned Judicial Magistrate, Uthamapalayam to dispose of the above Charge Sheet in C.C.No.509 of 2023 as expeditiously as possible. 1/4

2. The learned counsel for the petitioner would submit that in this case, though originally bail was cancelled, the accused were never secured and the matter was kept on delaying. Even now, the accused persons have surrendered and thereafter, were released on bail one after another and also absconding. On that ground, not even the charge is being framed.

3.In view of the grievances expressed by the learned counsel for the petitioner and also considering the fact that CC is of the year 2023, I am inclined to allow the prayer of the petitioner on the following terms:- i) The learned Judicial Magistrate, Uthamapalayam, is directed to take up the case in CC.No.509 of 2023 for early disposal and dispose of the same, in any event not later than two months from the date of receipt of a copy of this order.

ii) If the accused persons are not co-operating for framing charge, the learned Magistrate is requested to take appropriate action and frame the charge and proceed with the matter further. If any accused is absconding, the case can also be split up.

4.With the above terms, this Criminal Original Petition is allowed.
