(Crime No.84 of 2021) PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying this Court to direct the 1st respondent to consider and pass order on the petitioner's representation dated 05.10.2021 seeking for re-investigation of the case in Crime No. 84 of 2021, on the file of the 3rd respondent.

ORDER

The petition has been filed to issue a direction for reinvestigation in Crime No.84 of 2021, on the file of the third respondent.

2.The learned Additional Public Prosecutor submitted that on the complaint lodged by the petitioner, the third respondent registered a case in Crime No.84 of 2021 for the offences under https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD) No.17002 of 2021 Sections 341, 307 and 389 of IPC. However, after completion of investigation, the FIR itself referred as mistake of fact and the referred charge sheet filed before the Judicial Magistrate, Srirangam on 03.05.2021.

3.Therefore, re-investigation in Crime No.84 of 2021 does not arise. The criminal original petition is dismissed. However, the third respondent is directed to serve a copy of the referred charge sheet to the petitioner and on receipt of the same, the petitioner is at liberty to file a protest petition in a manner known to law, if so advised.
